Terms and Conditions of Sale - TRS Trains

1. About Us

​

TRS Trains supplies model railway products, components, and accessories, and provides servicing, fitting, and modification services for model locomotives and rolling stock.

 

2. Product Descriptions

​

We take all reasonable care to ensure that descriptions, specifications, and images of goods on www.trstrains.co.uk are accurate. Due to the nature of model railway products - including hand-built, hand-finished, or limited-run items - minor variations in appearance, finish, or detailing may occur and do not constitute a fault.

Some items may be supplied as pre-owned, modified, or commissioned stock. Where applicable, this will be clearly stated in the product description.

 

3. Pricing and Payment

​

All prices are listed in pounds sterling (£). Payment must be made in full before goods are dispatched or work is undertaken, unless otherwise agreed in writing. We reserve the right to amend pricing prior to order acceptance.

 

4. Consumer Rights – Goods

​

Under the Consumer Rights Act 2015, all goods supplied by TRS Trains must be of satisfactory quality, fit for their intended purpose, and as described at the time of sale.

 

Where an item is found to be faulty, damaged, or not as described, the customer is entitled to a repair or replacement in accordance with statutory consumer rights. Any such issue must be reported within a reasonable time of receipt and supported by clear evidence.

 

For goods that have been modified, commissioned, or fitted with additional components (including smoke units), assessment of any fault will be based on the condition of the item at the point of supply and the agreed specification. Characteristics inherent to bespoke work, material behaviour, or subsequent use, operation, or environmental factors do not constitute a fault.

 

5. Services, Fitting, and Modifications

​

Services provided by TRS Trains (including but not limited to servicing, digital installations, smoke fitting, and bespoke modifications) are carried out with reasonable care and skill in accordance with UK consumer law.

Due to the bespoke nature of modification work:

    •    Results may vary depending on the condition, age, or prior modification history of the model.

    •    Cosmetic changes or signs of prior use may occur during servicing or fitting and do not constitute a defect.

 

Once a locomotive or item has been modified or serviced at the customer’s request, it may no longer be eligible for return unless a fault is present with the work carried out.

 

6. Right to Cancel (Distance Selling)

​

For standard, unmodified goods purchased online, you have the right to cancel your order within 14 days of receiving the item, in accordance with the Consumer Contracts Regulations 2013.

To exercise this right, you must notify TRS Trains in writing within the cancellation period.

 

7. Exclusions from Cancellation

​

The right to cancel does not apply to:

    •    Custom-built, bespoke, or commissioned items

    •    Locomotives or stock that have been modified, serviced, or fitted at the customer’s request

    •    Sealed items that have been opened and cannot be returned for hygiene or operational reasons

These items may only be returned if faulty.

 

8. Returns and Refunds

​

    •    Returned goods must be unused and returned with original packaging where reasonably possible.

    •    Customers are responsible for return postage unless the item is faulty or incorrect.

    •    Refunds will be processed within 14 days of receipt of returned goods.

 

9. Misuse, Alteration, and Exclusions

​

TRS Trains cannot accept responsibility for faults or damage caused by:

    •    Incorrect use or installation

    •    Failure to follow operating or care instructions

    •    Use of unsuitable consumables (including liquids or additives)

    •    Customer modifications or third-party repairs

Such issues are not considered manufacturing or workmanship faults.

 

10. Limitation of Liability

​

TRS Trains’ liability is limited to the purchase price of the goods or services supplied, except where liability cannot be limited or excluded under UK law, including for death or personal injury caused by negligence.

 

11. Governing Law

​

These terms and conditions are governed by the laws of England and Wales.

 

12. Commissioned and Bespoke Work

​

Commissioned work includes (but is not limited to) custom-built models, bespoke modifications, repaints, detailing, digital or smoke installations, and any work carried out to a customer’s specific requirements.

Once a commission has been agreed in writing and paid for (in full or in part), the order is considered confirmed and work may begin immediately.

 

13. Cancellation of Commissioned Work

​

In accordance with the Consumer Contracts Regulations 2013, commissioned and bespoke items are exempt from the 14-day cancellation period, as they are made to the customer’s specifications.

If a customer chooses to cancel a commission after work has commenced, TRS Trains reserves the right to:

    •    Retain any deposit or full payment already made

    •    Charge for work completed to date, including materials, labour, and any non-recoverable costs

No refunds will be issued for commissioned work once materials have been ordered, parts fitted, or labour undertaken.

 

14. Change of Specification

​

Requests to change the specification of a commission after work has begun may not be possible. Where changes are agreed:

    •    Additional costs may apply

    •    Revised timescales may be required

    •    Previous work completed remains chargeable

All changes must be agreed in writing before work continues.

 

15. Approval and Completion

 

Where applicable, customers may be provided with progress updates or images. Once the commission is completed in line with the agreed specification, the work is deemed fulfilled.

A change of mind, aesthetic preference, or personal circumstance does not constitute a fault.

 

16. Faults in Commissioned Work

​

Commissioned work is covered by your statutory rights. If a fault arises due to workmanship or materials supplied by TRS Trains, we will offer a repair or correction in line with UK consumer law.

This does not cover:

    •    Normal wear and tear

    •    Damage caused by misuse or incorrect operation

    •    Issues arising from customer-supplied parts or prior modifications

 

17. Acceptance of Terms

​

By placing an order with TRS Trains, whether via www.trstrains.co.uk, www.trstrains.com, invoice, email, or any other ordering method, the customer confirms that they have read, understood, and agreed to these Terms and Conditions at the point of purchase.

These Terms and Conditions apply to all goods and services supplied by TRS Trains unless otherwise agreed in writing prior to purchase.

 

18. 3D-Printed Products and Resin Behaviour

​

Some kits and components supplied by TRS Trains are produced using 3D printing techniques and manufactured from resin-based materials.

Customers acknowledge that:

    •    Resin is a material that may change over time, including potential warping or             distortion

    •    The degree and likelihood of warping can vary between individual kits

    •    Environmental factors such as temperature, humidity, storage conditions, and             exposure to light can influence long-term stability

While TRS Trains takes reasonable care in the design, printing, and preparation of 3D-printed kits, minor warping over time is a known and sometimes unavoidable characteristic of resin-based products and does not constitute a fault.

This acknowledgement does not affect the customer’s statutory rights in the event of a genuine manufacturing defect present at the time of supply.

 

19. Damage in Transit

​

All goods are carefully packaged prior to dispatch. In the event that an item arrives damaged, the customer must notify TRS Trains as soon as reasonably possible and no later than 48 hours after delivery.

 

20. Evidence Requirements

​

To allow us to investigate and, where applicable, make a claim with the carrier, customers must provide clear evidence of transit damage, including:

    •    Photographs of the damaged item

    •    Photographs of the internal packaging

    •    Photographs of the external packaging, including any visible damage

    •    Retention of all original packaging until the issue has been resolved

Failure to provide adequate evidence or disposal of packaging before the issue is reported may affect our ability to offer a repair, replacement, or refund.

 

21. Returns Due to Transit Damage

​

Once damage has been reported and verified, TRS Trains will advise on the appropriate resolution, which which may include repair, replacement, or refund in accordance with UK consumer law.

Items must not be returned without prior authorisation. Unauthorised returns may be refused.

 

22. Exclusions

​

Damage reported outside the stated timeframe, or damage consistent with misuse, handling after delivery, or failure to follow storage or care instructions, may not be treated as transit damage.

Nothing in this section affects the customer’s statutory rights.

 

23. Smoke Unit Warranty

​

All smoke units and smoke fittings supplied or installed by TRS Trains are covered by a 12-month warranty from the date of supply or installation.

This warranty covers defects in materials and workmanship only.

 

24. Warranty Exclusions and Misuse

​

The warranty does not cover damage caused by misuse, neglect, or incorrect operation. This includes, but is not limited to:

    •    Stretched, damaged, or modified wiring

    •    Use of additives, oils, or chemicals mixed with water

    •    Use of unsuitable water, including hard tap water

    •    Failure to dry atomisers or components after use, leading to residue or mineral build-up

Unless explicitly stated otherwise, only bottled drinking water must be used with TRS Trains smoke systems.

Months of testing and development have gone into the design of these systems, and failure to follow usage guidance may result in damage not covered by warranty.

 

25. Repairs and Charges

​

Any damage caused by misuse or excluded under warranty will be chargeable. Repair costs will be assessed based on the extent of the damage and are typically charged at an hourly rate of £25 per hour, plus the cost of any replacement parts required.

 

26. Testing and Acceptance

​

All locomotives submitted for smoke fitting are subject to a running and functionality test prior to booking and/or return to the customer.

A smoke unit operating correctly at the time of testing and dispatch is deemed to be functioning as intended.

 

27. Statutory Rights

​

Nothing in this warranty affects the customer’s statutory rights under UK consumer law.
